Winny高裁判決。なんだ、この裁判官、地裁と違ってスゲー勉強してるぞ。ざっくり言うと匿名性は通信の秘密のために必要で重要な技術であろうと、言外を考慮するなら例え利用者が違法に利用していたとしても通信の秘密の確保を目指すのは違法目的とは呼べない正当な開発であろうということか。

あとは正犯についての参考で聞かれたのを証拠にしてるけど、これって黙秘権の確認とか無いから黙秘権を侵害してて証拠として無効だよねって話。

あと、著作権侵害が92%というのは数字のマジックで、Winnyに流れるデータのウチ51%が著作物と認識され、その内の92%という話だったらしい。流通量の半分以下だろうというところで蓋然性がアレだ。

結局Winnyは道具でアーキテクチャ的に中立だし、幇助って助力者がどんな風にそれを運用するのかを知らず可能性だけを認識している場合幇助にはならんし、そもそも金子氏は正犯のことを認識しようがないだろうjkという話か。
